NAR Files Amicus Briefs With Supreme Court To Protect Private Property Rights

December 19, 2023

On November 20, 2023, NAR filed amicus briefs with the Supreme Court of the United States in two cases supporting property owners facing unconstitutional violations of the Takings Clause under the Fifth Amendment.

The Sheetz v. County of El Dorado, California, case is of concern for developers since the case challenges the conditional issuance of a building permit on a required land-use exaction of over $23,000. These funds would help the County finance road improvements.

NAR believes there should be efforts to protect private property rights, which is why they are engaged in these court challenges. Use This Link to learn more about these property rights cases.
